What if I told you there was a way you could solve all your bad credit problems overnight by creating a brand new credit file in 24hrs – would you be interested? And what if I told you this program was 100% legal and even backed by the federal government – would that sound too good to be true?
Well… you’re right. It is too good to be true but these types of ads are now surfacing again after the Federal Trade Commission launched “Operation New ID Bad Idea” over 8 years ago. This operation targeted (and took down) over 50 credit repair organizations and companies selling consumers both pamphlets and services giving them a brand new credit file under the pretense it was 100% legal and in some cases even claimed it to be a “government sponsored” program!
The con was simple. Companies would target consumers with bad credit and offer to create a brand new credit file for them by substituting an Employer Identification Number (EIN) for their Social Security Number (SSN) along with a new address. EIN’s were obtained from the Internal Revenue Service on behalf of the consumer. With the EIN and a new address the companies would either have the consumer apply for credit with the “new information” or the company would apply for them. When the creditor would run the application it would automatically create a new credit file because the computer would be unable to find the consumer in the database due to the new address and SSN.
While there is some dispute among privacy experts as to whether or not this is legal, the FTC’s actions at the time were not up for debate. Companies were advertising and luring in consumers in order to have them falsify credit applications by providing new information such as their address and SSN in order to obtain credit. This was a direct violation of the Truth in Lending Act (TILA) and worse yet, the companies were advertising to consumers that this was 100% legal and in some cases claiming it was a government sponsored program. As you’ll hear me say often “In reality, nothing could be further from the truth”.
Privacy experts will argue that using an EIN or 9 digit PIN (simply a made up number) in place of ones’ SSN is completely legal since creditors are on shaky ground asking for your SSN in the first place. In regards to the truth in lending act they will argue that one has to exhibit “an intent to defraud” a creditor. My question “Is concealing ones’ adverse credit history intent in itself?” While I am not an Attorney on the matter of credit law I can conclude that if a consumer was to create an alternate credit file using the EIN or PIN method they better be darn sure they never have a problem paying their bills. If they do, they most likely would find themselves in a courtroom with a case involving credit fraud. Which brings me to my next topic.
How To Create An Alternate
Credit File Legally
Most consumers are unaware that in addition to consumer Credit Reports, both Experian and Equifax own and operate business credit reporting services. By creating a business credit profile a consumer can now create an alternate credit file legally. While some creditors such as residential utility companies will not allow you to use business credit in place of personal credit, we have had numerous clients who have successfully used business credit to obtain credit cards, automotive leases and loans. This technique (although controversial) can be very effective when done properly.
The basics of building business credit involve 1.) Setting up the proper structure for your business (i.e. Corporation, LLC, etc.). 2.) Obtaining an EIN as well as a DUNS number (Dunn and Bradstreet). 3.) Borrow and/or buy products and services from vendors who reports to business credit reporting agencies such as Experian, Equifax and Dunn & Bradstreet. While building business credit requires time just like personal credit, don’t get discouraged. Remember, when you set out to begin building your business credit you are starting with a clean slate. This is when it becomes imperative that one learn from the mistakes of their past. Remember, in the credit world those who do not learn from their past are (inevitably) doomed to repeat it.

You are entitled to a free copy of your credit report from the three major bureaus annually. Get a copy and review it before you take on any debt consolidation credit counseling. After completing counseling or a DMP check your credit report again for any notes or improvements. Some positive benefits to your credit report could be the removal of delinquent payments or “re-aging” of your accounts by creditors. Lenders may take credit counseling as a plus or a minus depending on their bias to words lending.
Do I Need Debt Consolidation Credit Counseling Before I File For Bankruptcy
There have been some important changes to understand with the adoption of the Bankruptcy act of 2005. You must complete federally approved credit counseling at least six months in advance of filing for bankruptcy. So even if bankruptcy is your preferred choice of action a good understanding of credit counseling is still needed.
Debt consolidation credit counseling can help you to take care of business. Do your research and find a great credit counselor. Don’t procrastinate get on with it immediately.

Whenever somebody applies for credit or financing, his or her credit report will be pulled electronically from any of the three major consumer reporting agencies (CRA). These CRAs are Experian, Trans Union, or Equifax – companies that are responsible for maintaining correct and up-to-date credit information around the country. Everyone is probably aware that these three nationwide credit bureaus have to monitor billions of data records therefore it is not inevitable to find errors with the reports. A majority of consumers would have at least one omission or inaccurate detail on their credit report.
It is for this very reason that as a consumer, the responsibility of checking your own credit information falls on your shoulders. Make sure that you get a copy of your credit report from each of the three Credit Reporting Agencies. You should contact each credit bureau and ask for your free credit report (you are entitled to 1 free copy every year). If you have been denied credit within the past 60 days, you are also entitled to a free credit report.

Using The Internet To Obtain Your Credit Report
You can also use the internet to obtain your credit report. Many companies offer instant access to your credit report online and will offer you a free credit report if you try their credit monitoring service for 30 days. Credit monitoring services are a great way to keep track of your credit and stop potential identity thieves. As soon as you or someone else applies for credit using your name and social security number, these services will alert you via email. If you did not request this new credit you just need to log into your account and start the process of alerting the credit bureaus of potential fraud activity.
How is the information found on your credit report used
The credit information that is reported on your credit report will be used to evaluate you when you apply for credit, insurance, employment, and other purposes allowed by the Fair Credit Reporting Act (FCRA). Therefore it is crucial that you review your Credit Reports for accuracy from at least annually.
Why is it important to monitor your credit report
By monitoring your credit report you will save yourself a lot of problems or unpleasant surprises when you have to get that credit card or if you’re considering buying a home. You will also be aware of any potential problems that may stop the credit grantor from approving you for the credit you seek. Knowing exactly what a lender will see when they pull your credit will allow you either try to dispute the items and have them removed from your report or prepare explanations for the credit problems and discuss them with your potential lender BEFORE you apply for that line of credit.
What to do if you find inaccurate information
- Be meticulous in examining your credit information. If you see any discrepancies, verify them as soon as possible. The law says that the credit bureau should examine the matter within a reasonable amount of time, usually 30 days.
- Dispute inaccurate information your credit report. Some credit repair specialist suggests you dispute items one at a time. Some say do it all at once. I have had clients that have done both, and there was never any one way that was more successful then the other in our case. I truly believe it depends on the agent you get at the credit bureau.
- Write an ORIGINAL dispute letter. Don’t just copy a form you found online. If you found it, then so did potentially hundreds if not thousands of other people. The agents at the credit bureaus in the disputes area have probably seen any freely given online dispute letter hundreds if not thousands of times. They will not take your request as seriously as they should if you do this.
The credit bureau is required to investigate and if that item cannot be confirmed within a reasonable amount of time, that credit record must be removed from the credit file. They must provide you with a free copy of your corrected credit report. Send your dispute letter to the credit bureau via certified mail, return receipt requested. If you are using a credit monitoring system you can do this online. Just make sure they send your dispute to all 3 agencies. If the credit bureau completes its investigation and decides that the negative information should remain in your file, you can add a letter of explanation to your credit report to refute the claim.

The content of your credit report can have an enormous impact on the quality of your life. Your credit score will determine the cost of your mortgage, your automobile payments, and your credit cards. An improvement in your credit score could potentially save you thousands of dollars per year.
Overcoming Your Fear
It is normal to experience a degree of fear when the time comes to look at your credit report. Perhaps you have had some credit issues in the past. No one likes to be reminded of those times. I have spoken to thousands of people about their credit over the years. The majority of those people have felt some resistance to looking at their own reports. I understand! The credit bureaus can be intimidating. But like so many other things in life, once you get started it’s not so bad.
Getting Started
Reviewing, repairing, and maintaining your credit is not complicated. The key is to approach the project in an organized manner. You have three Credit Reports. They must each be examined in detail. Many people make the mistake of looking only for obvious derogatory information like late payments or collections. Every item on your credit report can have an impact on your credit score. You will be looking at everything. I suggest that you have a pen and paper nearby. You will also need to have your credit cards handy.
Step by Step
Everyone has his or her own way of organizing a task. You will develop a system of your own over time. Whatever works for you is fine as long as you cover all of the essential categories of information that can impact your credit scores. These essential categories are the account opening dates, current balances, high credit limits, and pay history. As you review these items keep any eye out for errors such as accounts that don’t belong to you, accounts referencing an incorrect Social Security number or address, and duplicate accounts.
The Essential Details
Account opening dates, current balance, and high credit limit need to be examined carefully. The FICO scoring formula places great importance on these items. Your account opening dates are used in the FICO formula to determine the age of your credit. The older the better. Simply look at your credit card. Most credit cards indicate the original opening date somewhere on the face of the card. The relationship between your current balance and your high credit limit has a major impact on your score. If you don’t know these numbers just call the toll free number on the back of your card. Please don’t ignore this step.
Write Down Every Single Error
Make notes. Credit repair is all about the details. Don’t let a thing slip by. And please don’t ever assume that the credit report is correct. If you find a discrepancy chances are that you are correct. Every one of the categories listed above can have an impact on your credit scores. No error should be ignored. You might think a small innocent looking error like a duplicate account will not have a negative impact as long as there are no late payments showing. You would be wrong. The extra account will overstate your debt and may very well factor into the FICO scoring method to your detriment.
Organizing Your Disputes
Each error that you find on your credit report will need to be disputed with the individual bureau that is reporting the item in question. Your credit report will come with instructions for submitting your dispute. You should follow those instructions carefully. And, whatever you do, keep it simple. It is important to limit your verbiage to the bare minimum. If you make the mistake of writing a nice letter to the credit bureau, as well meaning as you might be, your dispute is likely to be ignored. It does not sound friendly, but please try to understand that the credit bureaus have to process an amazing amount of mail.
Stay the Course
About thirty days after your initial disputes you will receive replies from the individual credit bureaus. It is not uncommon to get an unsatisfactory answer. They might respond by indicating that they contacted the creditor who verified the information to be correct. Don’t be discouraged. This initial response is built into the system. Simply send a second dispute telling the bureau that you are not satisfied with their response and that you would like them to provide documentation. It is very likely that you will get satisfaction on this second dispute. The credit repair process can take time, but with patience your efforts will produce real financial results as well as the satisfaction of knowing that you have done the right thing for yourself.
